Center Wins Lawsuit to Stop Trash Burning Power Plant

On July 17, 2013, the Arizona Superior Court overturned a decision by the Arizona Corporation commission that would have given renewable energy credit to a trash incinerator via a waiver or pilot project.  The judge ruled that the Commision "erred and abused its discretion" in granting Mohave Electric Cooperative renewable energy credit for a proposed waste incinerator near Surprise, Arizona. 


Center files Lawsuit Challenging Legislature's Log-rolling

On Tuesday, July 16, 2013, the Center filed Staropoli et al. v. Arizona in the Maricopa County Superior Court.  The lawsuit seeks a declaratory judgment that SB 1454, passed in the final hours of the legislative session, violates the Constitution's single subject rule.  The case has been assigned to Hon. Randall Warner.

Center Appeals Flores Decision

On April 23, 2013, the Center filed a Notice of Appeal appealing the disappointing decision to vacate the judgment that Judge Collins handed down on March 29, 2013.  The plaintiffs' opening brief is due  August 1, 2013.
